1. Conditions of access to the Website
The website https://www.faymonville.group (the "Website") operated by Faymonville Distribution AG, a company incorporated under the laws of Luxembourg, with registered address at Z.A.E.R. Op der Sang, 16, Op der Bréimicht, 9779 Lentzweiler, Luxembourg and company registration number B94717 (the "Publisher").

The Website is accessible at all times anywhere in the world. The user who connects to it (the "User") bears sole responsibility for compliance with the legislation and/or regulations in force in the country where he/she resides or from where he/she connects to the Website.

By accessing or using the Website, you agree to be bound by these terms of use (the "Terms") which apply to all visitors to the Website, including business representatives accessing the Website in a professional capacity. If you do not agree, please discontinue use of the Website immediately.

2. Purpose of the Website
The Website is intended solely to provide general information about the Publisher and its products. The Website does not provide any service, and no contractual relationship, other than as set out in these Terms, is created between the Publisher and any visitor by virtue of accessing the Website.

3. Intellectual Property
All texts, images and other content on this Website are the intellectual property of their respective owners and are protected under authors’ rights, copyright and trademark laws. Any reproduction, distribution, or use whatsoever is strictly prohibited without prior written consent.

4. Modification of these Terms
These Terms may be modified by the Publisher at any time. The Terms applicable to any use of the Website are those available and published on the Website at the time it is consulted by the User. The invalidity or unenforceability of any provision of these Terms shall not affect the validity of the remaining provisions.

5. Newsletter
The User may subscribe to the newsletter in order to receive regular information by email. In this case, the newsletter subscriber (hereinafter the "Subscriber") accepts to provide the Publisher with contact details in the subscription form. The Subscriber confirms that he/she is the owner of the said email address and also agrees to receive informational, commercial and promotional emails from the Website or the Publisher.

The newsletter subscription process is logged as proof of consent in order to be compliant with data protection and e-commerce legislations. The logged data include the Subscriber's e-mail address, the time of subscription and the Subscriber's IP address, the language of the subscription form and any other relevant information the Subscriber may have communicated when filling out the subscription form.

The Subscriber may unsubscribe from the newsletter (or only from one of the topic-specific newsletter, when applicable) at any time by clicking on the unsubscribe link at the end of any newsletter.

The newsletters contain "web beacons", i.e. small invisible 1x1 pixel images enabling the Publisher’s system to detect when the Subscriber has fully opened the newsletter email. Newsletters may also contain "trackable links", that enable the newsletter tool to detect when the Subscriber clicks on a link included in the newsletter.

The goal of these measuring techniques is not to collect data on individual Subscriber' behaviour, but to gather statistical and anonymized information in order to improve the content and delivery of the Publisher’s newsletters, and to make them more relevant to the Subscriber.

All Subscriber-specific tracking information related to a Newsletter (newsletter delivery, opening signals, click signals) will automatically and permanently be deleted after a period that will not exceed forty-eight (48) months from the time of the newsletter mailing was sent.

6. Disclaimer
Although all information on the Website has been checked thoroughly, the User should not take the accuracy of the information for granted. The Publisher cannot be held responsible for the accuracy of the information provided on the Website nor give a guarantee that the details are complete, accurate and current. All information provided is subject to modification, error or omission.

The Publisher declines all responsibility for contents of third-party websites or social media platforms via hyperlinks from the Website or linking to it.

Finally, the Publisher cannot be held liable for and makes no warranty in the event of any interruption or malfunction of the Website as may be the case. The Publisher cannot be held responsible for direct or indirect damage incurred by the User as a result of access to the Website and its use.
